A complex legal battle is unfolding following the tragic December 2025 plane crash in North Carolina that claimed the lives of former NASCAR driver Greg Biffle and six others. Nicole Lunders, the ex-wife of the retired driver, has officially filed a wrongful death lawsuit against Biffle’s estate, the estate of pilot Dennis Dutton, and GB Aviation Leasing.

The legal filing details a sequence of alleged operational errors and critical mechanical missteps that contributed to the fatal outcome. The suit claims that despite poor weather conditions that demanded active monitoring, no flight plan was properly activated, and necessary radio contact was not maintained. It is alleged that the crew failed to turn on a vital generator responsible for providing power.

Greg Biffle’s ex-wife’s filing comes just weeks after the estates of both pilot Dennis Dutton and his son Jack Dutton filed their own separate wrongful death lawsuits against the Biffle estate.

The lawsuit stems from a catastrophic aviation accident that shook the NASCAR community. The crash killed all seven people on board, including Greg Biffle, his current wife, Cristina Grossu, his children Emma and Ryder, longtime NASCAR crew member Craig Wadsworth, pilot Dennis Dutton, and the pilot’s son, Jack Dutton.
The Dutton estates claimed the Biffle family owned the aircraft and failed to maintain it, which led to two $15 million wrongful death lawsuits filed by the families of the pilot and his son.
On top of that, local authorities have confirmed that Biffle’s estate is simultaneously the target of a massive post-mortem bank fraud scheme.
This leaves Greg Biffle’s remaining estate exposed from three distinct angles: the Dutton families, his ex-wife’s suit on behalf of Emma, and the house burglary, along with bank fraud.
